Douglas E. Schmidt, the senior trial lawyer at the Schmidt Salita Law Team, is scheduled to address the North Dakota Association for Justice, formerly North Dakota Trial Lawyers Association on the subject of “Overlooked Concussion and Traumatic Brain Injuries” on May 12, 2017 in Fargo, North Dakota.
Statistical data assembled by the Schmidt Law Firm shows that 60% of car accident victims have sustained a concussion injury. Of that group, only 70% have been diagnosed with a concussion or mild traumatic brain injury.
Many victims of concussion injuries do not seek medical attention. Those that do seek medical attention typically go to an Emergency Department. Yet, Emergency Medicine doctors admit that they are not able to reliably diagnosed a concussion injury. How could they? The patient is usually suffering from a physical injury and in pain. They are suffering from shock. Most have been given a pain medication. How, on earth, could any emergency doctor accurately assess for a concussion?
Additionally, medical literature establishes that the symptoms of concussion progressively develop over a period of many days or weeks post-injury. So, if the symptoms are going to show up later, how can the Emergency Doctor be expected to reliably diagnose the concussion? The answer that they can’t.
