The MINNESOTA MEDICAL MALPRACTICE LAWYERS at the Schmidt Salita Law Team score another major win in a jury trial in Hennepin County.
The jury returned a verdict of $2.5 million dollars against an orthopedic surgeon and the 125 doctor clinic.
Douglas Schmidt and Stephanie Schommer, with help from Dean Salita, represented a 60 year old woman who was undergoing a total knee arthroplasty (artificial knee joint). The claim was that the doctor didn’t properly screen the patient for surgery to determine that the knee was already infected. Further, when he opened the knee during surgery, he ignored evidence that it was infected and proceeded with the surgery. Further, when tests came back proving that the knee was infected, he ignored the advice of infectious disease specialists and failed to remove the infected prosthesis. Lastly, he discharged her from the hospital with the infected knee in place.
The case was vigorously defended in a trial lasting the most of 2 weeks. The jury verdict was unanimous.
