Doug Schmidt, the senior trial lawyer at the Schmidt Salita Law Team, together with partner Stephanie Schommer recently settled a wrongful death case for a 17 year old boy who was driving to school early in the morning in heavy fog when a large semi-truck/trailer veered across the center line, crashing head-on into the boy’s car.
Employing the expertise of an accident reconstruction engineer, the Law Team was able to “reconstruct” the collision by downloading data from the trucks “black box”. This data proved that the truck was traveling at an excessive rate of speed, i.e. between 50-60 mph in the heavy fog. This evidence proved that the truck driver, who survived without serious injury, had given false information to the Minnesota Highway Patrol about where his cruise control was set. This evidence was critical in bringing the truck driver and the trucking company to the table for a $2 million settlement.
