The Schmidt Salita Law Team announces a $500,000 settlement of a concussion injury which occurred in a car-bicycle collision. The settlement was reached even though the car driver started up on a green traffic light before the collision with the bicycle.

CAR DRIVER NEGLIGENT FOR STARTING ON GREEN LIGHT.

The driver of the car was negligent even when she started moving on a green light. She violated the law that requires drivers who are starting up after a red light to do so only after the intersection is clear of cross traffic. The driver was inattentive as she was starting up to take a right hand turn. She did not see the bicycle rider that was still in the intersection. Under the law, a motor vehicle operator is not permitted to move forward after the light turns green until the intersection is clear of traffic. In this case, the overhead traffic camera proved that the bicyclist had entered the intersection on a green light and had not been able to clear the intersection before the lights changed.

BICYCLE RIDERS ARE REQUIRED TO OBEY THE LAW.

Under the law, bicyclist are required to obey the laws that apply to all users of the streets and roads. In this case, the bicyclist was totally innocent. Even though she was trying hard to peddle through the intersection, she was unable to do so before the traffic lights changed.
