HIT & RUN, MISS & RUN-UNINSURED MOTORIST INJURY CLAIM
Pursuant to Minnesota law, a “hit and run” driver who leaves the scene and whose identity cannot be determined is defined as an “uninsured motorist”. As a result, the claim for injuries due to the fault of the “hit-and-run” driver can be collected against the victims on the uninsured motorist insurance coverage. This is true because, under Minnesota law, the “at fault motorist” is technically “uninsured” because that person’s liability insurance cannot be determined.
A “miss & run” driver is one who causes a collision without actual contact. For example, if an oncoming motorist passes the centerline and forces the other driver off the road and leaves the scene, that driver is a “miss & run” , or “near hit & run” driver. Pursuant to Minnesota law, the “miss and run” driver is treated the same as an “hit & run” driver so that uninsured motorist insurance coverage again applies.
The personal injury lawyers at the Schmidt Salita Law Tirm have experience in pursuing both uninsured motorist claims and underinsured motorist claims pursuant to Minnesota law. This type of claim can be especially difficult and the services of an experienced lawyer can be very valuable.
