Injury Lawyer Douglas Schmidt successfully prosecuted the record case involving a Burnsville representative that sustained major personal injuries in a case that was tried before judge and jury in the Dakota County Courthouse in Hastings Minnesota.
Schmidt client sustained major injuries to his foot and ankle when he came to the rescue of his dog that was being attacked by other dogs that had been brought to his home by construction workers. Schmidt argued that the Minnesota “dog bite statute” imposed strict liability on the owner of the attack dog owned by one of the workers. He also argued that the liability was imposed upon the owner of the construction company as well. Schmidt also argued that the dog owner’s liability transferred to Schmidt’s client even though the dog never bit the client because of the “rescue doctrine”.
After a heated trial, which was hotly contested, the presiding judge ruled that the Minnesota dog bite statute applied. After the judge’s ruling, the case was settled for an amount favorable to Schmidt’s client.
