The drunk driver is always at fault for causing injury in a motor vehicle collision. Minnesota’s liquor liability law imposes a legal responsibility on the bar, Sloan, restaurant, or other provider of alcoholic beverages for illegal sales to the drunk driver.
The two most frequent illegal sales are these: A. Sales to an underage person (minor). B. Sales to a person who is already obviously intoxicated.
When it can be proven that a car accident or other motor vehicle collision has been caused by the intoxication of a driver who became intoxicated as a result of an illegal sale, legal responsibility is imposed on the seller of the intoxicating beverage.
This law is sometimes written referenced as the “Dram Shop Law”.
