Injuries Caused by Commercial Trucks - The Higher Standard of Care

The victims of personal injury and wrongful death in accidents involving commercial trucks should seek a lawyer who is skilled and knowledgeable in handling commercial trucking cases.

Cases involving commercial trucking accidents are substantially different from typical auto accident cases because of the many regulations which are regulated by the U.S. Department of Transportation and enforced by the various states. These regulations, which typically also have been adopted by individual states, are set forth in the Federal Motor Carrier Safety Regulations (FMCSRs). The FMCSRs contain many regulations, the primary purpose of which is to promote the safe operation of commercial motor vehicles, including both the tractor and the trailer which is used in interstate commerce to transport passengers or property on highways. These regulations are important in the handling of injury and wrongful death cases involving trucks because they establish the many laegal responsibilities and legal liabilities of trucking companies.

In addition to being responsible the safety of their trucks, commercial carriers are required to ensure that their drivers comply with the safety regulations, even when those drivers are not direct employees. The truck drivers themselves are professionals, and are required to comply with regulations that require them to inspect their vehicles and to exercise “extreme caution” in difficult driving conditions.

These regulations prohibit the operation of any vehicle in a condition that will likely cause an accident or breakdown. The regulations include strict inspection standards. The regulations include strict requirements as to driver conduct. Drivers are required to perform basic safety inspections of their rigs and are held to a higher standard of care in the operation of their truck, particularly when the weather is bad. Under 49 C.F.R. § 392.14, extreme caution in the operation of a commercial motor vehicle shall be exercised when hazardous conditions, such as those caused by snow, ice, sleet, fog, mist, rain, dust, or smoke, adversely affect visibility or traction. Speed shall be reduced when such conditions exist. If conditions become sufficiently dangerous, the operation of the commercial motor vehicle shall be discontinued.
