$250,000 Recovery When Semi-Truck Collision with Bicyclist
Douglas E. Schmidt of the Schmidt Law Firm recently negotiated a successful settlement for a St. Paul, Minnesota woman who was hit by a semi-truck as she was riding her bicycle at an intersection in St. Paul. She was, at the time, crossing at a cross walk. As she did so, she passed in front of a U.S. Postal Service semi-truck. The trucker was in the process of attempting to make a right turn on a red light and did not see Schmidt’s client. As a consequence, her bicycle was knocked over and she was pushed along the pavement before onlookers alerted the truck driver’s attention to the problem.
The client sustained injuries to her leg which required skin grafting.
The case was a difficult one for many reasons. Principal among them was the fact that the claim was against the U.S. government and had to be brought under the Federal Tort Claims Act which forbids the filing of any lawsuit without first going through the process required by the Act.
Schmidt’s client had no No Fault insurance. Because the truck was owned by the U.S. government, it did not have No Fault insurance.
Despite these and many other obstacles, Schmidt successfully negotiated a settlement without having to take the case to court.
