Recovery for Trucker Burned in Semi Truck Fire

A Marshall, Minnesota truck driver was seriously burned in a collision of two trucks when the saddle tanks on his semi-truck burst into flames. The truck driver, who was represented by Douglas E. Schmidt of the Schmidt Law Firm, was able to escape, even though he sustained serious burn injuries. His co-driver died in the fire.

The collision occurred when the semi-truck driven by Schmidt’s client, collided with the rear of another truck which was a semi-truck tractor, traveling “bob tail” (without pulling a trailer) that had no rear lights. Schmidt’s client came over a hill and only saw the other truck when it was too late to avoid.

The collision ruptured the saddle tanks of the truck that was being operated by Schmidt’s client and the diesel fuel exploded in flames, causing a major fire.

Suit was filed against the other truck driver and Navistar, the manufacturer of the truck that was being driving by Schmidt’s client. A settlement was obtained from Navistar and the case went to trial against the other trucker. The claim against the other trucker was settled after 2 days of trial, thus avoiding the need for a decision by the jury.
