A fatal accident in North Carolina resulted in the death of a northern Iowa trucker when the tire on the right front steering axle had a “blow out”. The tire had been manufactured by B. F. Goodrich tire company and was on of a White Freightliner semi-truck.
This incident occurred as the truck was passing over a causeway over Lake Norman just north of Charlotte, North Carolina. As the result of the “blow out”, the truck was violently pulled to the right and went into the water. The trucker and his co-driver were both drowned.
A lawsuit was filed in Federal Court in Sioux City, Iowa. The suit was a wrongful death claim, brought on behalf of the family of the trucker. The suit, which was based on product liability, was brought against both B.F. Goodrich and White Freightliner, the manufacturers of the tire and the truck.
Schmidt assembled a team of experts, including an expert in truck tires, to support the claim. The suit was successfully settled after Schmidt convinced the lawyers for both defendants as to the validity of the case.
